Noveve Aesthetics is a trade name of DvG Medical Services, a sole proprietorship registered with the Chamber of Commerce under number 83470026, statutorily established at Judith Leysterlaan 4 in Pijnacker. The treatment practice of Noveve Aesthetics is located at Hoekeindseweg 163 in Bleiswijk.
Noveve Aesthetics also includes the certified medical professionals who are employed by, or contracted by, Noveve Aesthetics.
Client: the natural person and counterparty of 18 years or older who enters into a treatment agreement with the service provider. Service provider: the legal entity offering services to the Client, hereinafter referred to as: Noveve Aesthetics. Treatments: all treatments offered by Noveve Aesthetics include filler and botox treatments, as well as skin improvement treatments and PDO threadlifting. Treatment agreement: all agreements concluded between Noveve Aesthetics and Client regarding the requested treatment(s).
Article 2 – Applicability
These general terms and conditions apply to every offer by Noveve Aesthetics, every treatment agreement between Noveve Aesthetics and the Client, and every service offered by Noveve Aesthetics. Deviation from these general terms and conditions is in principle not possible. In exceptional cases, deviations may be made if explicitly and in writing agreed upon with Noveve Aesthetics. These general terms and conditions also apply to supplementary, amended and follow-up assignments with the Client. The applicability of articles 7:404 and 7:407 paragraph 2 of the Dutch Civil Code is expressly excluded.
Article 3 – Agreement
The agreement is concluded at the moment the Client gives Noveve Aesthetics an assignment to perform one or more treatments. The Client can only enter into a treatment agreement if it has been established that the Client:
Has reached the age of 18 and has presented a valid identification document;
Has been clearly and extensively informed prior to the treatment agreement about the treatment, possible risks and consequences, expected result, aftercare, costs and payment method, cooling-off period, and the timing of the treatment;
In case of guidance, care and/or accessibility, follows the instructions;
Is aware of the contact person at Noveve Aesthetics in case of complications, and contacts them immediately as discussed during the instructions;
Has completed the treatment form fully and truthfully (anamnesis form); all questions about the treatment have been asked and answered.
Prior to concluding the agreement, Noveve Aesthetics will inform the Client about the costs of the treatment. Costs of follow-up treatments and aftercare are not included, unless otherwise stated or as prescribed by the duty of care of Noveve Aesthetics. By agreeing to the agreement, the Client agrees to the costs and commits to paying them.
All offers made by Noveve Aesthetics are without obligation, unless explicitly stated otherwise in writing. Noveve Aesthetics reserves the right to refuse a treatment in accordance with legal, ethical and professional regulations. Noveve Aesthetics also has the right to refuse an agreement without giving reasons. Such a refusal does not entitle the Client to compensation or any other form of compensation.
The Client is at all times obliged to comply with the house rules and reasonable instructions of Noveve Aesthetics.
Article 4 – Obligations of Noveve Aesthetics
The doctors of Noveve Aesthetics may use registered medicines and other medical devices during treatment. The treating doctors act in accordance with their duty of care as competent service providers, as well as the requirements and guidelines applicable under the professional standard of their profession.
Noveve Aesthetics maintains a file regarding the Client's treatment, including medication use, treatments performed, results, complaints and other relevant information.
Article 5 – Obligations of the Client
The Client is obliged to cooperate at the first request of Noveve Aesthetics. In case of illness, medication use or other circumstances that may be relevant to the possible execution of the treatment, this must be discussed with the relevant doctor in advance.
The Client must inform Noveve Aesthetics as soon as possible if a scheduled appointment cannot be kept. When this occurs within 48 hours before the scheduled appointment, Noveve Aesthetics reserves the right to charge costs.
Article 6 – Prices and Payment
Unless otherwise agreed, the costs of the treatment are calculated on the basis of rates or prices unilaterally set by Noveve Aesthetics. The displayed prices should preferably be paid on-site at Noveve Aesthetics by debit card after the treatment.
The Client cannot derive rights or expectations from a previously provided estimate, unless expressly agreed otherwise.
Article 7 – Privacy, Data Processing and Security
Noveve Aesthetics handles the (personal) data of the Client carefully and uses it only in accordance with the privacy policy. If necessary, Noveve Aesthetics will inform the data subject. Questions about the processing of personal data and further information can be sent to info@noveve.nl.
If Noveve Aesthetics is obliged under the agreement to provide information security, such security shall meet the agreed specifications and a security level that, given the state of the art, the sensitivity of the data and the associated costs, is reasonable.
Article 8 – Liability
Noveve Aesthetics is insured against the risk of (professional) liability. The liability of Noveve Aesthetics is limited to direct damage and to the amount paid out under the liability insurance in the relevant case (increased by the amount of the deductible not covered by the insurer), with a maximum equal to the charged or yet to be charged costs of the treatment.
Compensation for indirect damage, including but not limited to side effects and consequential damage, is excluded at all times.
Article 9 – Confidentiality
Noveve Aesthetics and the Client undertake to keep all confidential information obtained in the context of an assignment confidential. Data about the Client will not be provided to third parties without the prior written consent of the Client.
The obligation of confidentiality does not apply if there is a legal obligation to disclose certain data. Noveve Aesthetics has the right to use the information obtained for statistical purposes. Noveve Aesthetics will ensure at all times that the information cannot be traced back to the individual client.
Article 10 – Intellectual Property Rights
All intellectual property rights and copyrights of Noveve Aesthetics are the exclusive property of Noveve Aesthetics. It is prohibited to publish and/or reproduce, modify or make available to third parties documents on which the intellectual property rights and copyrights of Noveve Aesthetics rest, without the express prior written consent of Noveve Aesthetics.
Noveve Aesthetics has the right to place images of Clients who have undergone treatment on its social media channels for promotional purposes after explicit, verbal and/or written consent has been obtained from the Client.
Article 11 – Complaints and Disputes
If the Client is not satisfied with the service and/or execution of the treatment agreement by Noveve Aesthetics, the Client is obliged to report these complaints as soon as possible, but no later than 2 weeks after the relevant cause that led to the complaint.
A complaint does not give the Client the right to publicly damage the reputation of Noveve Aesthetics. In case of violation of the provision in the previous clause, the Client owes Noveve Aesthetics an immediately payable fine of €100 per expression and €100 per day that the violation continues.
